These Terms and Conditions ("Terms") govern the access to and use of the Milko and Milko Biz mobile applications, websites, software, services, and related platforms (collectively referred to as the "Application" or "App") operated by Sanvix Technologies Private Limited ("Company", "we", "our", or "us").
By downloading, installing, registering with, accessing, or using the App in any manner whatsoever, you ("User", "you", or "your") acknowledge that you have read, understood, and agreed to be legally bound by these Terms, along with the Privacy Policy of the Company. If you do not agree with any provision of these Terms, you must discontinue use of the App immediately.
These Terms constitute a legally binding agreement between the Company and all users of the App, including milk vendors, milkmen, suppliers, delivery personnel, customers, business users, and any other persons accessing or using the App.
Milko and Milko Biz are technology-based platforms intended to facilitate record management, communication, scheduling, order tracking, customer management, delivery coordination, and related business support services between independent users.
The App functions solely as an intermediary technology platform and does not itself engage in the sale, purchase, supply, storage, distribution, transportation, or delivery of milk or dairy products.
The Company does not own, control, endorse, manufacture, inspect, verify, supervise, or guarantee any products, services, deliveries, pricing, quality standards, quantities, timings, or commitments made by users of the App.
All commercial dealings, transactions, understandings, communications, and arrangements are strictly and exclusively between the respective users, including milkmen and customers, at their own discretion and risk. The Company is neither a party to nor responsible for any transaction, agreement, understanding, dispute, or liability arising between users.
The App does not collect, receive, process, store, transfer, settle, or facilitate monetary payments between users unless expressly stated otherwise in writing by the Company.
All payments, settlements, refunds, credits, dues, or financial transactions relating to milk supply or related services are conducted independently and directly between the concerned users outside the App.
The Company shall not be liable for any payment disputes, failed transactions, delayed payments, unauthorized payments, overpayments, underpayments, fraudulent transactions, or financial losses arising between users. Users acknowledge and agree that the Company has no control over and assumes no responsibility for any monetary dealings between users.
By using the App, you represent and warrant that:
The Company reserves the right to suspend, restrict, or terminate access to any user found to be in violation of these Terms or applicable law.
Users are solely responsible for maintaining the confidentiality and security of their account credentials, login information, devices, and associated activities conducted through their accounts.
You agree that you shall not:
Users remain solely responsible for all data, content, communications, pricing, delivery commitments, customer dealings, and records maintained or transmitted through the App.
In order to provide and improve services, the App may request access to certain device permissions and user information, including contacts, media, camera, location, phone functionality, SMS verification, analytics data, and technical information. By using the App and voluntarily granting such permissions, you expressly consent to the collection, processing, and use of such information in accordance with the Company's Privacy Policy.

The Company may also use third-party analytics and performance monitoring tools, including Microsoft Clarity SDK, for collecting anonymized session analytics, heatmaps, interaction patterns, usage diagnostics, and technical insights to improve application functionality and user experience.
You may deny or revoke permissions at any time through your device settings, though certain functionalities of the App may consequently become limited or unavailable. Further details are available in the Privacy Policy, which forms an integral part of these Terms.
The App may contain integrations, links, APIs, software development kits, tools, or services operated by third parties. The Company neither controls nor assumes responsibility for the content, accuracy, availability, security, privacy practices, or conduct of any third-party services or providers. Your interaction with third-party services shall be governed solely by their respective terms and policies, and the Company shall not be liable for any damages, losses, liabilities, or claims arising therefrom.
All rights, title, interest, intellectual property, trademarks, logos, software, source code, designs, databases, interfaces, content, graphics, text, and technology associated with the App are and shall remain the exclusive property of Sanvix Technologies Private Limited and/or its licensors. Nothing contained in these Terms shall be construed as granting any license, ownership, or proprietary right to users except for a limited, non-exclusive, revocable, and non-transferable right to use the App in accordance with these Terms. Unauthorized copying, reproduction, modification, distribution, extraction, commercialization, or exploitation of any part of the App is strictly prohibited.
The App and all related services are provided on an "as is", "as available", and "without warranties" basis. To the fullest extent permitted under applicable law, the Company expressly disclaims all representations, warranties, guarantees, and conditions of any kind, whether express, implied, statutory, or otherwise, including but not limited to warranties relating to accuracy, reliability, availability, uninterrupted access, merchantability, fitness for a particular purpose, data integrity, security, compatibility, non-infringement, and operational performance.
The Company does not warrant that the App will always function without interruption, delay, defects, errors, cyber threats, or technical failures. The Company does not verify, monitor, guarantee, or assume responsibility for the quality, quantity, legality, hygiene, pricing, delivery, safety, or suitability of any milk, dairy product, or related service offered or supplied by users through or outside the App.
To the maximum extent permitted under applicable law, Sanvix Technologies Private Limited, its directors, officers, employees, affiliates, licensors, contractors, and agents shall not be liable for any direct, indirect, incidental, consequential, punitive, exemplary, special, or economic damages arising out of or related to:
Users expressly acknowledge and agree that all business, financial, commercial, operational, and personal risks associated with transactions conducted using the App are undertaken entirely at their own risk. Nothing contained herein shall exclude liability to the extent such exclusion is prohibited under applicable law.
You agree to indemnify, defend, and hold harmless Sanvix Technologies Private Limited, its affiliates, directors, officers, employees, agents, and representatives from and against any claims, actions, proceedings, liabilities, losses, damages, penalties, costs, or expenses, including reasonable legal fees, arising out of or related to:
The Company reserves the right, at its sole discretion and without prior notice, to suspend, restrict, disable, or terminate access to the App or any user account for reasons including violation of these Terms, suspected unlawful or fraudulent activities, misuse of the App, security concerns, legal or regulatory requirements, or operational or technical reasons. Termination of access shall not affect accrued rights, obligations, liabilities, or remedies available to the Company under applicable law.
As the App does not process or manage payments between users, the Company does not provide refunds, cancellations, chargebacks, reimbursements, or payment guarantees of any kind. Any refund requests, shortages, pricing disputes, delayed payments, excess collections, or related financial issues must be resolved directly between the concerned users without involvement or liability of the Company.
The Company reserves the unrestricted right to amend, revise, update, or modify these Terms at any time without prior notice. Updated Terms shall become effective immediately upon publication within the App or through other official communication channels. Continued use of the App following such updates shall constitute acceptance of the revised Terms.
These Terms shall be governed by and construed in accordance with the laws of India. Any dispute, controversy, or claim arising out of or relating to these Terms, the App, or the services provided therein shall be subject to the exclusive jurisdiction of the competent courts located within the territorial jurisdiction where Sanvix Technologies Private Limited maintains its registered office.
If any provision of these Terms is held to be invalid, illegal, unenforceable, or contrary to applicable law, the remaining provisions shall continue in full force and effect.
Important: By using Milko App, all users agree that they cannot bring any legal claim, compensation request, or liability case against Sanvix Technologies Private Limited or the Milko / Milko Biz App for issues related to milk delivery, product quality, pricing, payment disputes, or data collected via app permissions or analytics (Microsoft Clarity).
